            No one is in attendance on behalf of the appellant, no intimation is received. On the previous two dates of hearing when the matter was fixed for order as to non-prosecution, no one was in attendance on behalf of the appellant and the matter was adjourned in the interest of justice, whereas, direct notice was issued to the appellant, which as per bailiff report, has been duly served, however, no one has shown appearance. Instant appeal was filed on 12.09.1978 and, thereafter, it appears that the appellant has not remained vigilant to pursue the matter, which is fixed today for order as to non-prosecution, as the duplicate set has not been supplied. Accordingly, we left with no option, but to dismiss instant appeal on account of non-prosecution alongwith listed application.
