O R D E R

1.         Learned counsel for the appellants seeks urgency on the ground that the matter has been settled with the parties, therefore, the appellants intend to withdraw instant appeal. Urgency application is granted. 

2.         Through listed application filed under Order XXIII Rule 1 CPC, which is duly signed by the five appellants and their counsel duly supported by the affidavit of appellant No.2, whereas, a letter dated 29.06.2022 issued by the respondent Bank showing acceptance of full and final settlement of the outstanding liabilities, has also been annexed alongwith instant application.

            Learned counsel for the appellants submits that since the matter has been settled between the parties, therefore, the appellants want to withdraw instant appeal. Learned counsel for the respondent waives notice of instant application and claims its copy, which has been supplied to him in Court, who does not oppose withdrawal of instant appeal in view of above statement. Accordingly, instant appeal stands dismissed as withdrawn alongwith listed application.
