1.         Urgency granted.

2.         The petitioner present in person alongwith his counsel does not press instant petition, as according to him, he has shifted from the subject area, whereas, as per instructions the Cantonment Board has written a letter to the occupants of the subject premises for action in accordance with law and also to remove illegal construction accordingly.

            Learned counsel for the occupants of the area submits that the respondents are bonafide purchasers of the subject units in the premises and residing therein since last several years, however, they have made request to the builders and Cantonment Board Clifton to supply copy of relevant document of approved building plan and, thereafter, in case of any violation of the approved building plan to seek regularization of such construction, if any, in accordance with law.

            Learned counsel for the respondent No.1 submits that all necessary documents and the information will be provided to the respondents, whereas, appropriate action will be taken against illegal construction after notice to all concern in accordance with law.

            In view of the aforesaid position, instant Petition stands dismissed as withdrawn, however, the Cantonment Board Clifton shall ensure that in case of any violation of the approved building plan appropriate action will be taken against illegal construction after notice to all concern in accordance with law and in case the occupants of the area approach the Cantonment Board Clifton for regularization, if so permissible under the law, such request may also be considered in accordance with law.
