After hearing the learned counsel for the parties at some length, High Court Appeal No.311/2019 is dismissed as withdrawn, whereas, High Court Appeal No.355/2019 is also disposed of with the directions that the respondents will not create any third party interest in the matter, whereas, the parties will make a request before the learned Single Judge to treat the suit as short cause, frame issues and record evidence within a period of three months and, whereafter, judgment and decree may be passed. The disposal of instant High Court Appeals is, however, without prejudice to the stance and claim of the parties, which will be agitated before the learned Single Judge.
