            Appellants are called absent, no intimation is received. Instant appeal was being represented by Mr. Shahenshah Hussain, Advocate on behalf of the appellants, who sought discharged of his vakalatnama vide order dated 01.09.2022, whereafter, direct notice was issued to the appellants and the matter was fixed in Court on 03.10.2022, when no one was in attendance on behalf of the appellants and the following order was passed: -

“No one is in attendance on behalf of the appellant, no intimation is received. On the last date of hearing, learned counsel for the appellants has sought discharge of his vakalatnama, whereafter, direct notice was issued to the appellants, however, no report regarding service or otherwise is available on record.

Office is directed to issue notice to the appellants, to be served through concerned District Judge, who may submit compliance report on the next date of hearing.

Adjourned, to be fixed after four weeks.”

Today, neither the appellants are in attendance, nor office objection has been complied with. The matter is pending since 1985 without any useful progress, whereas, no restraining order is operating. It appears that the appellants have lost interest in pursuing instant appeal, which is accordingly dismissed on account of non-prosecution alongwith listed applications.
