1&2.    After arguing the matter at some length and while confronted as to how instant High Court Appeal is maintainable, as no adverse order has been passed, on the contrary the counsel for the appellants has been directed to satisfy the Court as to maintainability of the application, which is still pending in the subject suit, learned counsel for the appellants does not press instant High Court Appeal and submits that he will pursue the remedy before the learned Single Judge in the suit.

            Accordingly, instant High Court Appeal is dismissed as not pressed alongwith listed application.
