Appellant and his counsel are called absent, no intimation is received. On the previous two dates of hearing also, when the matter was fixed in Court for order as to non-prosecution no one has shown appearance on behalf of the appellant, whereas, the matter was adjourned in the interest of justice while granting time to do the needful and intimation notice was issued to the counsel for the appellant, however, inspite of such fact, no one has come forward to comply with office objection, nor no one is in attendance.

Record shows that instant appeal was filed on 15.11.2021, however, after having filed it, the appellant and his counsel never remained vigilant, who have lost interest in pursuing instant appeal, which is accordingly dismissed on account of non-prosecution.
