Dated; 3rd April 2023

Mr. Muhammad Haroon Shaikh, Advocate for Petitioner.

-*-*-*-*-*-

1.         Urgency granted.

2.         Learned counsel for the petitioner undertakes to comply with office objection before the next date of hearing.

3.         Exemption granted subject to all just exceptions.

4&5.    Learned counsel for the petitioner was directed to satisfy this Court as to maintainability of instant petition, which prima facie appears to be totally misconceived, as neither the petitioner is an aggrieved person, nor any cause of action has been created to the petitioner to file instant petition, whereby, petition alleges that Pakistan Railway is not getting their premises vacated from the respondents No.8&9, who according to learned counsel, are not making payment, which belongs to Pakistan Railway. However, learned counsel for the petitioner could not submit any reasonable explanation Accordingly, instant petition is misconceived and not maintainable, which is hereby dismissed alongwith listed application. It is, however, observed that K-Electric and NEPRA shall look into the matter to ensure smooth supply of electricity to the consumers in accordance with law.
