2. Exemption granted subject to all just exceptions.

3&4. Through instant Constitution Petition, the petitioner has alleged that impugned construction raised by the respondent No.3 on the subject plot is in violation of the approved building plan. However, it appears that the petitioner has not approached the relevant authorities for the purpose of ascertaining, as to whether such construction has been raised as per approved building plan or otherwise, nor it appears that petitioner is the resident of the area, whereas, the construction appears to have been completed.

While confronted with hereinabove position, learned counsel for the petitioner does not press instant petition and submits that the petitioner will approach the relevant authorities for the purpose of ascertaining the status of construction raised on the subject plot in accordance with law.

Accordingly, instant Petition stands dismissed as not pressed alongwith listed application.
