The Superintendent Central Prison, Karachi, has sent a report dated 30.12.2005 stating therein that the Respondent No.4 Yousuf son of Qadir Baksh has expired in the Hospital on 12.12.2005, where he was sent for treatment as Under Trial Prisoner, as ordered by this Court on 2.12.2005. Superintendent Central Prison, Karachi, has submitted death certificate, issued by RMO, Dow University of Health Science & Civil Hospital, Karachi, Department of Medicine Unit One. From the above it is clear that the Respondent No.4 has expired. Learned AAG and Advocate for the complainant have also confirmed the above position. In the circumstances the appeal against Respondent No.4 is abated.
Heard advocates for the appellants, complainant and AAG for the State. Reserved for judgement.
