Learned counsel for appellant points out that captioned Crl. Jail Appeal had proceeded along with Confirmation Case No. D-11 of 2021 and that such matters were decided by a learned Division Bench of this Court vide a Judgment dated 16.11.2021, whereby the sentence of death was reduced to one of imprisonment for life, however the subject of Section 382-B Cr.P.C, remained unaddressed, hence the listed application under Section 561-A Cr.P.C.

Be that as it may, we have observed that a Statement has been filed on behalf of the Complainant, reflecting that the aforementioned Judgment rendered in the matter has been impugned before the Supreme Court through Crl.PLA No.1683/2022. On query posed, learned counsel for the Appellants conceded that the same remained pending. Under such circumstances, the listed Application stands dismissed while leaving the Appellants at liberty to move a fresh application on the subject following disposal of the matter by the Supreme Court, if the outcome thereof so permits.
