Prima facie this Crl. Acquittal Appeal is barred by time inasmuch as whilst the same seeks to impugn the Order made on 12.08.2022 by the Additional Sessions Judge-IV (Hudood) Sukkur in Crl. Case No.428/2018, it has been presented as belatedly as 11.08.2023.

No one had been in attendance on behalf of the Appellant on the previous date, when the matter had been adjourned but with it being observed that counsel ought to come prepared on the next date so as to address the point of limitation. Be that as it may, upon the matter being taken up today at the first call, we were informed by Mr. Muhammad Asif Kolachi, holding brief for Mr. Imdad Ali Malik, Advocate, that counsel was engaged before another Bench. At his request, the matter was kept aside for proceeding after the tea break. However, upon the matter then being taken-up accordingly, counsel for the Appellant was said to have left the Court premises so as to attend to professional engagements before some other forum. Under the given circumstances, the Appeal stands dismissed for non-prosecution.
