2. The applicant by way of instant Crl. Misc. Application has impugned an order dated 25-01-2022 passed by learned Additional Sessions Judge, Gambat whereby his application u/s 193 Cr.P.C for joining the private respondent as accused was dismissed by learned Additional Sessions Judge Gambat.

At the very outset, it is stated by learned counsel for the applicant that he would not press the disposal of instant Crl. Misc. Application before this Court on merits provided the applicant is permitted to repeat his application u/s 193 Cr.P.C for joining the private respondents as an accused after his examination, if something positive connecting them with commission of incident he is able to brought on file of learned trial Court, which is not opposed by learned DPG for the State. Order accordingly.
