O R D E R

Through aforesaid bail application, applicants, namely, Bashir Ahmed, Shabir Ahmed and Muhammad Hussain seek their Pre-arrest bail in Crime No.329/2023 registered at Police Station, Moro for offence punishable under Sections 506/2, 353, 448, 504, 34 PPC after their bail was declined by Additional Sessions Judge, Moro vide order dated 11.07.2023.

2. Facts of the case are mentioned in the FIR and copy whereof is attached with bail application therefore, there is no need to re-produce the same.

3. Heard Counsel for the parties and perused the record.

4. From the perusal of record it appears that all the Sections applied in the FIR are bailable in nature, so far as the Section 506/2 PPC is concerned, from the contents of FIR tentatively not applicable and its applicability will be decided by the trial Court after recording evidence of PWs. Learned counsel for complainant as well as learned Additional Prosecutor General after such a situation have raised no objection for confirmation of bail.

5. In view of above, the applicants have make out their case for grant of bail resultantly, this application is allowed. The interim pre-arrest bail already granted to the applicants named above vide order dated 17.07.2023 is hereby confirmed on same terms and conditions.

Bail application stands disposed of.
