4.                     It is contended by learned counsel for the petitioner that the father of petitioner was having landed property, the same is not being mutated in favour of his legal heirs by the respondents, therefore they be directed to do the needful. Issue of inheritance is subject to entitlement, which involves factual controversy; therefore, it would be unjustified to direct the respondents to mutate the property left by late Shoukat Ali in favour of petitioner or others in summary manner under the garb of harassment by this Court by way of instant petition, in exercise of its constitutional jurisdiction. Consequently, the instant petition being misconceived is dismissed in limine.
