4 & 5.              It is contended by learned counsel for the petitioner that the petitioner being a High School Teacher has not been considered for his promotion as Head Master by the respondents, therefore, such action to be declared illegal with direction to them to consider the petitioner for his promotion as Head Master and in the meanwhile, the operation of the notification whereby certain High School Teachers have been promoted as Head Master to be suspended to the extent of Male High School Teachers of District Qamber-Shahdadkot.

                        None of the person promoted under subject notification, the operation whereof has been sought to be suspended by the petitioner, has been joined as party to the instant petition; such omission on the part of the petitioner could not be overlooked. Even otherwise, issue of promotion or suspension of notification whereby a civil servant is promoted relating to terms of service, in presence of bar contained by Article 212 of Constitution of Islamic Republic of Pakistan, 1973 could not be adjudicated upon by this Court in exercise of its constitutional jurisdiction.

                        Consequent upon above discussion, the instant petition being misconceived is dismissed in limine.
