ORDER

Zulfiqar Ali Sangi, J- Through this revision application, applicant Ali Gohar Memon has assailed the order dated 05.12.2022 passed by learned Additional Sessions Judge, Ratodero (District Larkana) in Criminal Complaint No.64/2022, whereby the learned Judge has dismissed the complaint filed by the applicant under provisions of Illegal Dispossession Act, 2005.

            The applicant has alleged his illegal dispossession from inherited landed property i.e. Survey No.769 ad-measuring (02-06) acres, situated in Deh Ratodero by the accused/ respondents No.1 to 4.

            On the other hand learned counsel for respondents No.1 to 4 submits that the respondents No.1 to 4 are not in possession of any area out of aforesaid survey number. He further added that, the dispute between the parties, if any, is over demarcation. However, both the learned counsel are agreed for carrying out the demarcation by the revenue authorities.

            As such, by consent of the parties this revision stands disposed of with observations that the applicant may approach concerned revenue authorities by filing an application for demarcation of the land in question, which would be decided within a period of preferably one month.
