                        The facts in brief necessary for disposal of instant Crl. Transfer Application are that the applicant by making an application U/S. 528 Cr.PC sought for transfer of his case from the Court of learned 1^st Additional Sessions Judge, Kandhkot, for the reason that he is apprehending danger to his life at the hands of his rivals while attending that Court; it was not opposed by other side yet was dismissed by learned Sessions Judge, Kashmore @ Kandhkot by observing that no case could be transferred from one to other Court at the wish of the parties. It is in these circumstances, the applicant by way of instant application U/S.526 Cr.PC has sought for transfer of his case from the Court of learned 1^st Additional Sessions Judge, Kandhkot, by pleading his enmity at Kandhkot, which is not opposed by learned Addl.P.G for the State. Consequently, the subject case is withdrawn from the file of learned                   1^st Additional Sessions Judge, Kandhkot and made over to the file of learned Additional Sessions Judge, Kashmore, for its disposal according to law.

                        The instant Crl. Transfer Application is disposed of accordingly.
