                        The applicant by filing instant Crl.Misc.Application U/S.561-A Cr.PC has sought for quashment of FIR Crime No.23/2022, Offence U/S.365, 452 PPC of P.S Ali Goharabad Larkana. On being asked, it was stated by learned counsel for the applicant that challan of the case has already been submitted by the police before the Magistrate having jurisdiction and cognizance whereof has also been taken by the Court having jurisdiction. After cognizance of the offence by the Court of competent jurisdiction, no FIR could be quashed by this Court legally. Consequently, the instant Crl.Misc.Application being misconceived is dismissed in limine together with listed applications, directing the applicant to prove his innocence by joining the trial, if so is advised.
