          Applicant/UTP Mst. Saima has sent this application from Special Prison for Women, Larkana contending therein that she is facing trial for offence under section 9 (c ) of the Control of Narcotic Substances Act in FIR No.13/2008 of Police Station, Garhi Khero pending in the Court of learned Sessions Judge, Jacobabad. She has been granted bail in the sum of Rs.500,000/-, therefore, the amount of surety be reduced from Rs.500,000/- to Rs.100,000/-.

          On perusal of the material available on record it appears that the applicant was traveling in the jeep along with her two kids namely, minor boy Danish and baby Seema with her husband Muhammad Khursheed while the vehicle was being driven by Ghulam Sarwar, from which 90 kilogram of charas concealed in its secret cavities were recovered on 30.3.2008. As per report received from the learned District & Sessions Judge, Jacobabad it reveals that the applicant has been granted bail in the sum of Rs.500,000/- by this Court in Crl. Bail Application No.404/2008 vide order dated 22.8.2008 but she is unable to arrange such a big surety and is still languishing in jail along with her two minor kinds.

          I have hard the learned State counsel Miss. Rubina Dhamrah, who extended her no objection in granting the application.

          Under the circumstances, on perusal of the material available on the record I am of the considered view that applicant/UTP Mst. Saima under the peculiar circumstances of the case has made out a case for reduction of surety amount. Reliance may be placed on 1998 P.Cr.L.J 1465. In view of the above, the application is granted. Surety amount is reduced from Rs.500,000/- to Rs.100,000/-
