Irshad Ali Shah, J;- It is alleged that on arrest from the applicant was secured 5500 grams of Bhang by Police party of PS Airport Sukkur, for that he was booked and reported upon. On having been refused bail by learned Ist Additional Sessions Judge/ (CNS)/MCTC-I Sukkur, he has sought for the same from this Court by way of instant Crl. Bail Application u/s 497 Cr.P.C.

2 Heard arguments and perused the record.

3. Despite advance information, no independent person was associated by complainant by ASI Hub Ali to a witness the arrest of the applicant and recovery allegedly made from him; such omission on his part could not be lost sight of. Only 500 grams of the Bhang have been subjected to Chemical Examination, therefore, liability of the applicant would only be to that extent. The case has finally been challaned and there is no apprehension of tempering with the evidence on the part of the applicant. In these circumstances a case for release of the applicant on bail on point of further inquiry obviously is made out.

7. In view of above the applicant is admitted to bail subject to his furnishing solvent surety in sum of Rs.30,000/- and P.R bond in the like amount to the satisfaction of learned trial Court.

8. The instant bail application is disposed of accordingly.
