Petitioner Rafiullah Khan Niazi,  widow Zainab Bibi , son of the deceased Asad Jehangir and four daughters are present alongwith their counsel Mrs.Arjumand Khan.

Through  this application under Sections 278 of the Succession  Act, 1925, the Petitioner has prayed for grant of  Letters of Administration  in respect of  the  properties left by the deceased Jhangir Khan Niazi, details whereof have been disclosed in  Schedule-C to the Petition.

            In Para 3 of the Petition it has been stated that deceased Jhangir Khan Niazi at the time of his death left behind Mst. Zainab  Bibi (widow), Nargis Jhangir (daughter), Rafiullah Khan Niazi (son), Nusrat Jhangir (daughter), Asad Jhangir (son), Nighat Jhangir (daughter) and Iffat Jhangir(daughter) as  his surviving legal heirs. One of the legal heirs/sons of the deceased is not present who has executed Power of Attorney in favour of the petitioner.

            After filing of this Petition, required formalities viz. publication of notice etc.have been complied with. Two independent witnesses Muhammad Anwar Khanand Mutiullah Khan,  present  in Court, have also affirmed these facts in their affidavits already filed before this Court alongwith the Petition. No objections from any corner have been received against the grant of this Petition.

 There seems no legal impediment in granting this  Petition. Accordingly, it is granted and office is directed to issue Letters of Administration in favour of the  Petitioner as per Rules.
