2. Facts in brief necessary for disposal of listed application are that the applicant was convicted U/S.489-F PPC and sentenced to undergo rigorous imprisonment for 02 years by learned 1st Judicial Magistrate, Ratodero, vide judgment dated 21.02.2023, which he impugned by preferring an appeal; it was dismissed by learned Additional Sessions Judge, Ratodero, vide judgment dated 18.03.2023, which is impugned by him before this Court by preferring the instant criminal revision application and in the meanwhile he has sought for his release on bail by suspending the operation of impugned judgment, for the reasons that the sentence awarded to him is short one; he was enjoying the concession of bail at trial and hearing of his revision application is likely to take time, which is not opposed by learned Addl.P.G for the State.
Heard arguments and perused the record.
In view of above, while relying upon case of Abdul Hameed Vs. Muhammad Abdullah and others (1999 SCMR-2589), the operation of the sentence awarded to the applicant is suspended, consequently, he is directed to be released on bail subject to his furnishing surety in sum of Rs.50,000/- and P.R bond in the like amount to the satisfaction of Additional Registrar of this Court.
Listed application (M.A.No. 1404/2023) is disposed of accordingly.
Adjourned to date in office for hearing of main revision application.
