            Learned counsel for applicant submits that, the applicant being proposed accused was not heard while passing impugned order and directions for registration of F.I.R were issued. Learned D.P.G. after going through the impugned order admits this position. The, impugned order itself reflects that the proposed accused were not heard, therefore, there is clear violation of Article   10-A of the Constitution of Islamic Republic of Pakistan. Accordingly, the impugned order is set aside and matter is remanded back to Court below for passing the order afresh after hearing the proposed accused. This criminal miscellaneous application stands disposed of in above terms.
