Misc. Application u/s 561-A Cr.P.C are that applicant
Fazul Rehman was admitted
to interim pre arrest bail by this Court; his bail application was dismissed as
not pressed; consequently his bail bond/surety was forfeited by this Court vide
order dated 28-03-2022, the applicant/surety now has sought for recalling the
above said order of this Court only to the extent of forfeiture of his bail
bond/surety. After dismissal of the bail application as not pressed, legally
there was no need for recording forfeiture of bail bond/surety, that too without
notice to the applicant/surety in terms of section 514 Cr.P.C
being mandatory. Consequently, the subject order is recalled only to the extent
of forfeiture of bail bond/surety.
The instant Crl.
Misc. Application is disposed of accordingly.
