The facts in brief necessary for disposal of instant Crl. Misc. Application are that on investigation of FIR Crime No. 64/2022 u/s 354, 506/2, 504, 148, 149 PPC of PS Khuhra, the applicant was found to be innocent and let off accordingly by the police; he was joined in trial by learned IIIrd Civil Judge & Judicial Magistrate Gambat vide order dated 03-11-2022, which is impugned by the applicant before this Court by way of instant Crl. Misc. Application.

2. Heard arguments and perused the record.

3. The applicant is named in the FIR and allegation against him take support of ancillary evidence. In these circumstances, learned trial Magistrate was right to join him in trial by way of impugned order, which is not found to be illegal to be interfered with by this Court by way of instant Crl. Misc. Application. It is dismissed accordingly directing the applicant to prove his innocence by joining the trial, if so is advised to him.
