4. The applicant by way of instant Crl. Misc. Application has sought for production of Mst. Saba to be set free by this Court after recording her statement, who as per his counsel is confined illegally by the private respondents within jurisdiction of PS Baberloi, District Khairpur. No cogent reason is advanced by the applicant for having approached this Court directly, without exhausting the remedy which was/is available to him before Sessions Court concerned. Consequently, office is directed to transmit the instant Crl. Misc. Application u/s 491 Cr.P.C to learned Sessions Judge Khairpur for its disposal in accordance with law.
