4. It is contended by learned counsel for the applicant that learned trial Court by way of impugned order by recalling the complainant for purpose of further cross examination has provided a chance to the prosecution/private respondent to fill in the lacuna, which is not permissible at law, therefore, such order being illegal is liable to be set aside.

Heard arguments and perused the record.

The recalling of the complainant for purpose of further cross examination would not only help the Court to arrive at right conclusion, but would given an end to the feelings of the prosecution/private respondents that they are being denied right of fair trial, contrary to the mandate contained by Article 10-A of Constitution of Islamic Republic of Pakistan, 1973. No cogent reason is advanced by the applicant; which may justify this Court to make interference with the impugned order by way of instant Crl. Revision Application, it is dismissed in limini.
