Irshad Ali Shah, J;- It is alleged that on arrest from the applicant, is secured unlicensed pistol of 30 bore with magazine, which he allegedly used for committing offence outcome of FIR No. 112/2022 u/s 324, 353, 398, 401 of PS Gambat, for that the present case was registered.

2. Heard arguments and perused the record.

3. There is no independent witness to the incident despite spy information, such omission on part of the complainant could not be overlooked, the subject pistol is said to have been foisted upon the applicant by the police; the case has finally been challaned and there is no apprehension of tempering with the evidence on the part of the applicant. In these circumstance; a case for release of the applicant on bail, on point of further inquiry obviously is made out.

4. In view of above the applicant is admitted to bail subject to his furnishing solvent surety in sum of Rs.50,000/- and P.R bond in the like amount to the satisfaction of learned trial Court.

5. The instant Crl. Bail Application is disposed of accordingly.
