                   Applicant Waris Ali Solangi seeks pre-arrest bail in Crime No.101/2022, registered at P.S Kashmore, for offence u/s 337-A(i), 337-F(i), 337-A(ii), 337-F(ii), 427, 452, 506/2, 114, 504, 147, 148, 149, PPC.  Previously, applicant applied for the same relief before the learned Additional Sessions Judge, Kashmore. The same was rejected vide order dated 06.08.2022. In Cr. Bail Appln. No.S-401/2022 applicant Mohammad Zaman Solangi seeks pre-arrest bail in Crime No.99/2022, registered at P.S Kashmore, for offence u/s 337-F(vi), 337-A(i), 337-F(i), 337-L(ii), 504, 114, 147, 148, 149, PPC. Previously, applicant Muhammad Zaman applied for pre-arrest bail before the learned Additional Sessions Judge, Kashmore. Same was rejected vide order dated 06.08.2022.

 

                   Admittedly, these are counter-cases. Yet it is to be determined which party is aggressor.  Moreover, alleged offences do not fall within the prohibitory clause of Section 497, Cr.P.C. In such cases grant of bail is a rule and refusal is an exception, but no exception is attracted in these cases. No objection to the confirmation of interim pre-arrest bail already granted to the applicants/accused has also recorded by the complainant of each case.  In the view of above, interim pre-arrest bail already granted to the applicants/accused Waris Ali Solangi and Mohammad Zaman Solangi is hereby confirmed on same terms and conditions.

 

                   In the view of above, both bail applications are accordingly disposed of.
