Zulfiqar Ali Sangi, J-. Learned counsel for the applicant submits that through this criminal miscellaneous application, applicant Muhammad Ibrahim Soomro has impugned the NBW issued against him by learned Presiding Officer of Sindh Labour Court No. VIII, Larkana, in connection with Case No.13/2022 (Assistant Director Labor and Inspector of Factories Larkana v. Ghulam Hyder Shaikh and others). Per learned counsel the order for issuance of NBW against applicant is quite harsh, unfair and miscarriage of justice, as ordinary process of summons, then B.Ws and thereafter NBWs was supposed to be adopted, but the learned trial Court has directly issued NBW against applicant, which is against judicial principles. He further contended that the applicant is a responsible police officer and he has always high respect and regards for the Courts of law and had never been negligent in obeying the orders of the Courts of law. Per learned counsel, the applicant intends to appear before the learned trial Court to furnish his reply/ explanation and unconditional apology, but since the NBW has been issued against him, the applicant is unable to appear directly before the learned trial Court, therefore, he prays for suspension of the NBW. 

 

            Since, the applicant intends to appear before the learned trial Court with his explanation; as such NBW issued against him in aforesaid case is hereby suspended enabling him to appear before learned trial Court. The application stands disposed of in above terms along with listed applications.
