          Through this bail application the applicants/accused seek pre-arrest bail in Crime No.292 of 2009 registered under Section 322/34 PPC at PS Korangi Industrial Area, Karachi-East,.

          Precisely, the prosecution story is that on 30.3.2009 the complainant received information that his father Ashiq Masih has died due to suffocation resulted in water tank. It is further stated that the other labours, namely, Amir Abdullah, Syed Sultan Mahmood and Shahrukh have also died. Such death resulted due to carelessness on the part of applicants. The complainant registered such FIR on 31.3.2009.

          Learned counsel for the applicants/accused contends that the investigating agency after completing investigation has filed its final report for disposal of the case in ‘C’ Class, therefore she prays for confirmation of interim bail.

          Learned Assistant Prosecutor General Sindh after going through the police file confirms the disposal of case in ‘C’ Class and concedes to the confirmation of interim bail granted to the applicants/accused.

          Since the investigating agency has recommended the case for disposal in ‘C’ Class, therefore I confirm the interim pre-arrest bail granted to the applicant on 5.6.2009 on the same terms and conditions.
