It is contended by learned counsel for the appellant that the offence for which the appellant has been convicted is bailable and aggregate sentence awarded to the appellant is 03 years with diyat and there is no likelihood of early hearing of his appeal. By contending so, he sought for release of the appellant on bail by suspending the operation of impugned sentence, which is not opposed by learned DPG for the State.

In view of above, while relying upon the case of Abdul Hameed Vs. Muhammad Abdullah and others (1999 SCMR-2589), the operation of impugned sentence is suspended and the appellant is directed to be released on bail, subject to his furnishing surety in sum of Rs.100,000/- (Rupees One Lac Only) and PR bond in the like amount to the satisfaction of Nazir of this Court.

Instant listed application is disposed of accordingly.

Adjourned to be fixed for hearing of main appeal after preparation of paper book.
