By way of listed application (MA No.12796/2022), appellant Habibullah has sought for his release on bail for the reason that including remission, he has already served out 23 years of his sentence, yet his appeal is not being disposed of, which is not opposed by learned Addl. P.G for the State.
In view of above, while relying upon case of Makhdoom Javed Hashmi vs. The State (2007 SCMR 1844), the sentence awarded to the appellant Habibullah is suspended, consequently, he is directed to be released on bail subject to his furnishing surety in the sum of Rs.100,000/- (Rupees One Lac) and P.R bond in the like amount to the satisfaction of Nazir of this Court.
The listed application (M.A.No. 12796/2022) is disposed of accordingly.
