QAISER IQBAL-J: Learned counsel for the Applicant has resorted to move this Cr. Bail Application in Crime No.293/2003, under Section 365-A, 302, 34 PPC read with Section 7 (e) of the A.T. Act, 1997 of Police Station Mehmoodabad, Karachi.
It is urged by the learned counsel for the Applicant that the Applicant was convicted by the learned Trial Court, consequent thereupon A.T. Appeal No.03/2004 was submitted before this Court, which was also dismissed vide judgment dated 13.06.2005.
The Applicant through Superintendent, Central Prison, Karachi has proceeded to file Jail Petition No.276/2005 pending adjudication before Honourable Supreme Court of Pakistan wherein Leave to Appeal has been granted.
When confronted with the legal position, how this Cr. Bail Application and M.A No.2022/2009 whereby permission has been sought for adjudication of the plea of bail by the Applicant in pending cause before Apex Court, learned counsel for the Applicant was not in a position to controvert the situation and requested for withdrawal of Cr. Bail Application.
In view of the above, Cr. Bail Application being withdrawn hereby stands dismissed along with listed application.
