After hearing learned counsel for the parties at some length and by consent of both the learned counsel for the parties, instant High Court Appeal is `disposed of` in the following terms:-

[i]. Para 4 of the impugned order dated 08.08.2016 is hereby set-aside.

[ii]. Learned Single Judge is directed to decide Suit No.2461/2015 as per issues already framed in Para 5 of the impugned order, after recording evidence, preferably, within a period of six months from the date of this order, whereas, learned counsel for the parties are directed to proceed with the matter on each and every date with due diligence, without taking unnecessary adjournment(s).

Instant High Court Appeal stands `disposed of` in the above terms alongwith listed application.
