            Through instant petition, petitioner has sought for directions of this Court to the official respondents, including the police to take action against such delinquent persons, who are engaged in the illegal business of manufacturing and selling of “gutka’ in the Province of Sindh.

Notices were issued, pursuant to which comments have been filed on behalf of the respondents No.1 to 3 alongwith annexures, wherein it has been stated that manufacturing and selling of “gutka” is prohibited by law, whereas, action is being taken against such delinquent persons allover Province of Sindh.

Learned Addl. A.G. Sindh submits that number of criminal cases have also been registered against such persons, whereas, regular surveillance is kept in this regard by the police and other respective departments.

Petitioner present in person submits that he will be satisfied and will not press instant petition, if directions are issued to the respondents, particularly the Secretary of Food Department, Government of Sindh, for ensuring continuous action against the delinquent persons, who are found engaged in illegal business of manufacturing and selling of “gutka” and criminal cases may be registered against them in accordance with law.

Since, comments to this effect on behalf of the respondents have already been filed, wherein such assurance has been given by the respondents to ensure action against this menace in accordance with law, whereas, learned Addl. A.G. Sindh has also expressed the prompt action by official respondents to this effect, we would dispose of instant petition with directions to the respondents to ensure that no one should be allowed to carry out the illegal and unlawful business of manufacturing and selling of “gutka” in the Province of Sindh, which otherwise, being banned, is hazardous to the health of the citizen, whereas, continuous legal action shall be taken against such delinquent persons so that this menace may be eliminated from the society. Let quarterly report with regard to such efforts as well as legal actions taken by the respondents may be furnished in Court through MIT.

Petition stands disposed of.
