O R D E R

The case of applicant is that her son was abducted by the proposed accused on the pretext that he has contracted marriage with Mst. Soomal and thereafter such FIR bearing crime No.123 of 2019 under section 365‑B, 147,148,149 PPC was lodged at Police Station Mirpur Mathelo. Subsequently the dead body of deceased Mst. Soomal was recovered and FIR bearing crime No. 125/2019 under section 302, 201, 34 PPC at PS Mirpur Matheo, same was also disposed of by the I.O in ‘A’ Class and subsequently the Magistrate concerned has approved the summary in ‘C’ class. It seems that role of Investigating Officer and role of the S.S.P Ghotki is questionable that when the FIR bearing crime No. 123/2019 at Police Station Mirpur Mathelo for the abduction of lady was lodged and subsequently the dead body of the deceased was recovered but neither the S.S.P Ghotki nor I.O has taken efforts to protect the life of deceased Mst Soomal but infact they were left at the mercy of the accused persons and they have not investigated the matter, surprisingly the case was disposed of under ‘A’ class. Still Muhammad Bakhsh the husband of deceased Mst. Soomal is missing but no efforts has been taken by the police of district Ghotki to recover the alleged detenue. This is third case before me within seven days in which the girls are being abducted by the different persons and such F.I.Rs were registered at Police stations but police of district Ghotki failed to recover the alleged detenues and on the Court directions yesterday viz. 12.01.2022 a girl was recovered by the police. If this state of affairs continued, then it would be very hard for the common people to survive, because the police officials are so lethargic in performing their duties and obeying the orders of the Courts. In such circumstances, S.S.P Ghotki is directed to recover Muhammad Bux husband of Mst. Soomal and produce him on next date of hearing with further directions that what he has not taken actions against all police officials who failed to provide protection to deceased Mst. Soomal. In such circumstances S.S.P Ghotki is directed to appear in person along with explanation. Let the copy of this order be sent to Inspector General of Police Sindh, Karachi for information.
