            Learned counsel for the petitioner, under instructions, submits that the appeal filed by petitioner before the Custom Appellate Tribunal has been finally heard, whereas, judgment has been reserved, therefore, petitioner will not press instant petition, provided that respondents may be directed not to take any adverse action against the petitioner for the recovery of impugned demand, which is subject matter of appeal, which has been duly heard and reserved for judgment by the Appellate Tribunal till its final decision. Whereas, in case the Appellate Tribunal decides such appeal against the petitioner, recovery may not be affected for another period of seven days from the date of receipt of appellate order by the petitioner to seek further remedy in accordance with law.

Learned Asst. Attorney General and learned counsel holding brief do not oppose such disposal of petition.

            Accordingly, instant petition stands disposed of in the above terms alongwith the listed application. However, it is expected that the Customs Appellate Tribunal may decide the appeal of the petitioner within four weeks from the date of receipt of this order.
