            Through the instant constitution petition, petitioners Irshad Ahmed and others have prayed for the following relief.

a)                     To direct the respondents to reform / reschedule of polling stations in following respects:

” The block No. 331020216 may be shifted from GPS Shah Muhammad Mazarito GPS HulurChachar, Block No.331020219 may be shifted from GPS AkhwaniMazari to GPS Shah Muhammad Mazari and Block No.331020218 may be shifted from GPS HulurChachar to GPS Akhwani, on humanitarian grounds so that voters can feel easy to cast their votes, which is their constitutional right, guaranteedby the Constitution of Pakistan, 1973.”

 

2.         Notices were issued against the respondents as well as D.A.G.

3.         Parawise comments are filed by respondent No.3.

4.         Learned counsel for petitioners contended that D.R.O refused to entertain the application of the petitioners for change of polling station, finding no other way petitioners have approached this Court directly. It is further submitted that present location of aforesaid polling stations would cause inconvenience to the voters of that area.

5.         In the parawise comments filed on behalf of respondent No.3 it is mentioned that petitioners were required to approach D.R.O for change of said polling stations. Reference has been made to section 59 of Elections Act 2017.        

6.                     Admittedly petitioners directly approached this Court without approaching District Returning Officer in the first instance. Contention of learned counsel that D.R.O refused to entertain their application is without any substance. Counsel appearing on behalf of Election Commission of Pakistan, has informed that lists of polling stations has already been finalized and the same has been published and available on website of Election Commission of Pakistan. No interference at this stage is required. Petition is without merit and the same is dismissed.
