Comments filed by the respondents
No.1 to 5, taken on record, copy whereof provided to learned Counsel for
petitioner who after going through the comments shows satisfaction for disposal
of the petition and submits that directions may be issued to Irrigation
Department to decide the application of petitioners and other Khatedars filed
by them after issuance of notice and hearing to all concerned.
Learned Counsel for
respondent No.7 and learned AAG have recorded no objection for the above
proposal.
In view of above, by consent
of parties instant petition stands disposed of with directions to respondent
No.4 to decide the application submitted
by the petitioners and other khatedars as per their revenue record and
Irrigation law after hearing them by preparing new share list as per law within
a period of 45 days. The compliance report be submitted to this Court through
Additional Registrar of this Court.

Through this Constitution
Petition the petitioner has prayed for following relief(s);
a)
To direct the respondents
Irrigation Department to release proper due water (as per share list) towards
the lands of the petitioner through watercourse No.76-AR of Ali Bahar Wah, in
order to enable him to irrigate his lands properly.
b)
To direct the respondents No.5
and 6 to record their statements before this Honurable Court and assure that
they will provide legal and lawful protection
and will not harass the petitioner and
his family members and will not implicate into the false cases in future at the
instance of respondents No.8 to 10.
c)
To grant any other equitable
relief as deemed fit by this Honourable Court in circumstances of the case.
On query, learned Counsel for
petitioner submits that at the first instance, the petitioner wants to approach
before competent authorities of Irrigation Department.
In view of above, instant
petition stands disposed of along with listed applications. However, officials
of Irrigation Department is directed to redress the grievance of the petitioner
after hearing him and decide the matter as per law within a period of 30 days whenever
petitioner approached them. The compliance report be submitted to this Court
through Additional Registrar of this Court.
