In compliance of the court direction, SHO PS Patni files report which reflects that there is dispute between the private parties over the land property, otherwise no such offence as alleged by the applicant in the contents of his application has taken place.

After arguing the matter at some length, learned counsel for the applicant submits that he will be satisfied and would not press the instant Crl. Misc. Application, if applicant may be provided a chance to file the direct complaint before the Court having jurisdiction. Such proposal is not opposed by learned counsel for the proposed accused as well as learned APG for the State.

In view of above, the instant Crl. Misc. Application is dismissed as not pressed. However, the applicant is liberty to file a direct complaint for redressal of his grievance before the competent Court having jurisdiction, if so advised.
