            Appellant and his counsel are called absent, no intimation is received. On the last two dates of hearing also, no one was in attendance on behalf of the appellant and the matter was adjourned as a last chance. Today, position is same, neither the appellant nor his counsel is in attendance without intimation.

From perusal of record it appears that instant appeal was filed on 18.04.2018, whereafter, appellant and his counsel have not remained vigilant to proceed with the matter, whereas, no stay is operating in the instant case. It appears that the appellant has lost interest to proceed with the matter. Accordingly, instant appeal is dismissed for non-prosecution alongwith listed application.
