            Learned counsel for the petitioner submits that the petitioner will be satisfied and will not press instant petition; provided that respondents may be directed to allow provisional release of the consignment of the petitioner subject to securing the disputed amount of duty and taxes and the penalty, if any, before the concerned Collectorate in the shape of pay order or bank guarantee, which shall not be encashed till final disposal of the appeal filed by the petitioner before the concerned Collectorate.

Learned Asst. Attorney General as well as learned counsel holding brief for learned counsel for the respondent and the officers of the respondent do not oppose disposal of instant petition in the aforesaid terms.

Accordingly, instant petition stands disposed of alongwith listed application. It is expected that compliance of this order shall be made as soon as pay order or bank guarantee is furnished by the petitioner before the concerned Collectorate.
