The applicant has impugned order dated 26.10.2021, passed by learned 5th Additional Sessions Judge, Shikarpur, whereby his direct complaint for prosecution of the private respondents was dismissed.
It is contended by the applicant that learned trial Court has dismissed his direct complaint by way of impugned order, without considering the material brought on the record; therefore; such order being illegal is liable to be set aside by this Court with direction to learned trial Court to take cognizance of the offence.
Learned Addl.P.G for the State and learned counsel for the private respondents by supporting the impugned order have sought for dismissal of the instant criminal revision application by contending that the applicant is in habit to make applications and complaints against the private respondents off and on, only to satisfy his dispute with them over the landed property.
I have considered the above arguments and perused the record.
The applicant by way of filing a direct complaint has sought for direction against SHO, P.S Dakhan to register his case and to provide protection to him as he may be able to cultivate his land and to take crop there-from, it signifies the fact that the applicant is intending to satisfy his civil dispute with the private respondents by involving them in a criminal case with aid of the police. In these circumstances, learned trial Court was right to dismiss the direct complaint of the applicant by way of impugned order, which is not calling for interference by this Court.
In view of above, the instant criminal revision application is dismissed accordingly together with listed application.
