No one is in attendance on behalf of the respondents, whereas, as per bailiff report, it appears that except respondent No.5, all respondents could not be served. Let notices be repeated upon unserved respondents, to be served through first thee modes, whereafter, bailiff shall submit compliance report as well as courier delivery report shall be placed on record. To come up after four weeks.

Learned counsel for the appellant submits that a restraining order was passed by this Court on 17.02.2022 directing the Nazir of this Court not to release the share amongst the legal heirs pursuant to the impugned judgment and decree, however, as per Nazir’s report already furnished, such amount has already been released, which per counsel, has been done in haste manner, hence requests that Nazir may be directed to submit comprehensive report as to when copy of aforesaid order was received in the office of Nazir and how without notice, such amount has been released in favour of the respondents. Nazir may furnish report in this regard before next date of hearing.

Interim order passed earlier to continue till next date of hearing.
