2. Learned counsel for the appellant undertakes to comply with office objection before next date of hearing.

3&4. Instant appeal has been filed against judgment dated 08.04.2021 and decree dated 12.04.2021 passed by the learned Banking Court No.IV, Karachi in Suit No.43/2014 filed by the respondent for recovery of the amount against the appellant, whereby, the suit has been decreed alongwith cost of fund.

Learned counsel for the appellant submits that inspite of the fact that the respondents did not comply with the provisions of Section 9 of the Financial Institutions (Recovery of Finances) Ordinance, 2001, whereas, the documents furnished alongwith the suit were forged documents, however, this aspect of the matter has not been taken into consideration by the learned Banking Court while passing the impugned judgment.

Let pre-admission notice be issued to the respondents, to be served through first three modes, for 13.09.2021, when objection, if any, shall be filed with advance copy to the learned counsel for appellant.
