2. Exemption granted, but subject to all just exceptions.

3&4. After arguing the matter at some length and while confronting as to maintainability of instant petition, as prima facie it appears that the petitioner has no privity of contract with the respondent and claiming possession over the subject property through previous licensee whose licence has been cancelled by the respondent.

Learned counsel for the petitioner submits that the petitioner will not press instant petition and may seek the remedy by approaching appropriate forum in accordance with law, however, requests that respondents may be directed to abide all the auction policy while granting fresh licence in respect of the subject property in accordance with law.

Accordingly, instant petition is dismissed as not pressed, however, petitioner may approach the appropriate forum for redressal of his grievance, if any, in respect of his possession as claimed by him.
