Appellant and his counsel are called absent, no intimation is received. Instant High Court Appeal was filed on 20.05.2019 against an order dated 26.04.2019 passed by the learned Single Judge, on the original side, of this Court in Suit No.2386 of 2017, whereby, CMA No.16612/2018 filed under section 114 CPC for review of order dated 22.10.2018 passed by the learned Single Judge by consent of the parties, has been dismissed. Record reveals that after having filed instant appeal, appellant and his counsel have not remained vigilant to pursue this matter, which is fixed in Court after lapse of more than two years, whereas, from perusal of impugned order, it further appears that the appellant was seeking review of a consent order and the learned Single Judge after taking into consideration the entire facts of the case has rightly dismissed such request of the appellant, as no ground for seeking review could be made out because it was a consent order. It appears that the order passed by the learned Single Judge has been complied with, therefore, the appellant is not coming forward to pursue instant appeal, which accordingly is dismissed on account of non-prosecution alongwith listed applications.
