                        The applicant by way of instant Crl.Misc.Application has impugned order dated 24.12.2021, passed by learned Judicial Magistrate, Kashmore at Kandhkot, whereby he has returned the FIR relating to theft of oil to be submitted before the Court having jurisdiction. As per learned counsel for the respondents, the interim challan of the case has already been submitted and cognizance whereof already been taken by FIA Court at Sukkur. If it is so, then only the remedy available with the applicant is to impugn the order of cognizance of the offence, which has been taken by FIA Court at, Sukkur. Consequently, the instant Crl.Misc.Application having become infructuous is dismissed, accordingly.
